SUPPLEMENTAL NOTICE OF PROPOSED CHANGES ON THE PRINCE WILLIAM SOUND SHRIMP POT FISHERY IN THE REGULATIONS OF THE COMMERICIAL FISHERIES ENTRY COMMISSION.
This is a SUPPLEMENTAL NOTICE adding to the NOTICE OF PROPOSED CHANGES issued on MAY 24, 2024 concerning the proposed revisions below. The department has released this SUPPLEMENTAL NOTICE to advise the public of a continued hearing date and to reopen the comment period to the public.
BRIEF DESCRIPTION
The Commercial Fisheries Entry Commission (CFEC) proposes to adopt the regulation changes to Title 20, chapter 5 of the Alaska Administrative Code that are identified in the May 24, 2024 NOTICE OF PROPOSED CHANGES dealing with limitation and permitting of entry under AS 16.43 into the Prince William Sound commercial shrimp pot fishery, P09E and P91E.
You may comment on the proposed regulation changes, including the potential costs to private
persons of complying with the proposed changes, by submitting written comments to the Alaska
Commercial Fisheries Entry Commission at P.O. Box 110302, Juneau, Alaska 99811-0302.
Additionally, the commission will accept comments by facsimile at 907-789-6170, and by
electronic mail at DFG.CFEC.PublicQuestions@alaska.gov. Comments may also be submitted
through the Alaska Online Public Notice System, by accessing this notice on the system and
using the comment link. The comments must be received not later than 5:00 P.M. on July 24,
2024.

After the public comment period ends, the CFEC will either adopt the proposed regulation

regulation. You should comment during the time allowed if your interests could be affected.

BRIEF DESCRIPTION
The Commercial Fisheries Entry Commission (CFEC) proposes to change regulations concerning the Prince William Sound commercial shrimp pot fishery.
The Commercial Fisheries Entry Commission (CFEC) proposes to adopt regulation changes in Title 20, chapter 5 of the Alaska Administrative Code, dealing with the limitation of entry under AS 16.43 into the Prince William Sound commercial shrimp pot fishery, P09E and P91E, including the following:
- 20 AAC 05.310(i) is proposed to be amended to add the Prince William Sound shrimp pot fishery as a fishery that has reached levels of participation that require limitation of entry.
- 20 AAC 05.320(h) is proposed to be amended to add the maximum number of entry permits allowed for the Prince William Sound shrimp pot fishery.
- 20 AAC 05.330 is proposed to be amended to add a subsection (z), which sets the qualification date for the Prince William Sound shrimp pot fishery.
- 20 AAC 05 is proposed to be amended to add the following new sections to Article 6:
- 20 AAC 05.837. General provisions relating to the Prince William Sound shrimp pot fishery.
- Subsection (a) provides the eligibility criteria for those who wish to apply for an entry permit into the Prince William Sound shrimp pot fishery.
- Subsection (b) provides the application dates for applicants.
- 20 AAC 05.838. Priority classification system for the Prince William Sound shrimp pot fishery.
- Subsection (a) establishes the use of a point system for the Prince William Sound shrimp pot fishery.
- Subsection (b) provides the point scale the CFEC will use.
- 20 AAC 05.839. Point system for the Prince William Sound shrimp pot fishery.
- Subsection (a) establishes the criteria used to measure an applicant’s past participation in the fishery, the maximum number of points available for past participation, and the criteria used for the awarding of points.
- Subsection (b) establishes criteria used to measure an applicant’s economic dependence on the fishery, as well as criteria used to measure applicants' consistent participation and financial investment in the fishery. Additionally, this subsection provides the maximum number of points available for this subsection and the criteria used for awarding points.
- 20 AAC 05.840. Designation of significant and minor hardship classifications for the Prince William Sound shrimp pot fishery.
- Subsection (a) establishes priority classifications that will be designated as applicants who would suffer significant economic hardship if excluded from the fishery and the kind of permit these classifications will receive from the CFEC.
- Subsection (b) establishes priority classifications that will be designated as applicants who would suffer minor economic hardship if excluded from the fishery and the kind of permit these classifications will receive from the CFEC.
- 20 AAC 05.841. Definitions.
- Paragraphs (1) through (3) define the terms “commercially harvested”, “participation” or “participating”, and “pounds,” as those terms are used in
20 AAC 05.837 – 20 AAC 05.839.
