Notice of Proposed Changes- Alaska Pioneers' Homes Rates & Levels of Service

NOTICE OF PROPOSED CHANGES ON THE ALASKA PIONEERS’ HOMES RATES & LEVELS OF SERVICE, IN THE REGULATIONS OF THE DEPARTMENT OF HEALTH & SOCIAL SERVICES.

 

BRIEF DESCRIPTION

The Department of Health & Social Services proposes to change regulations on the rates charged to residents, levels of service, payment assistance, and admission to an Alaska Pioneers’ Home.

 

 

The Department of Health & Social Services proposes to adopt regulation changes in Title 7 of the Alaska Administrative Code, dealing with the rates charged to residents, levels of service, payment assistance, and admission to an Alaska Pioneers’ Home, including the following:

 

(1) 7 AAC 74.010. Quality and levels of service, is proposed to be changed as follows: Clarify the definitions of the types of services provided at a home.

 

(2) 7 AAC 015. Eligibility for Admission, is proposed to be changed as follows:

  • Amend applicant age eligibility for admission.
  • Clarify applicant rates and charges.

 

(3) 7 AAC 74.025. Rates, is proposed to be changed as follows:

  • Amend monthly rates for service levels; amend rate for day and respite services and describe process for rate adjustment.

 

(4) 7 AAC 74.040. Payment for services in a pioneers’ home, is proposed to be changed as follows: Describe payment for services and charges to residents.

 

(5) 7 AAC 74.045. Payment assistance, is proposed to be changed as follows: Amend exemptions.

 

(6) 7 AAC 74.050. Personal needs allowance; priority of payments from income, is proposed to be changed as follows: Amend amount related to resident monthly income from all sources income other than the department.

 

(7) 7 AAC 74.990. Definitions, is proposed to be changed as follows: Amend definitions.

 

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to the Department of Health & Social Services, Division of Alaska Pioneer Homes, RE- Regulation Change, at P.O. Box 110690, Juneau, AK 99811. Additionally, the Department of Health & Social Services will accept comments by facsimile at (907) 465-4108 and by electronic mail at alaskapioneerhomes@alaska.gov.  The comments must be received not later than 5:00 p.m. on December 7, 2020.

 

You may provide oral comments relevant to the proposed action via telephone at the hearing to be held on November 18, 2020, by calling 1-800-905-9496. Please note that in-person attendance will not be permitted at the hearing site because of the public health and safety concerns associated with the COVID – 19 pandemic. Please prepare to share your oral comments by telephone only. The hearing is scheduled from 11 a.m. to 1 p.m., and priority will be given to commenters on the line before the beginning of the hearing. The hearing may be extended to accommodate those on the line before 12:40 p.m., who did not have an opportunity to comment. The Department of Health & Social Services may, before the hearing begins, limit the time allotted for each person providing oral testimony. The time limit may be necessary to conclude the hearing in the time provided.

Box 110690, Juneau, AK 99811. The questions must be received at least 10 days before the end of the public comment period. The Department of Health & Social Services will aggregate its response to substantially similar questions and make the questions and response available on http://dhss.alaska.gov/daph/Pages/default.aspx  and the Alaska Online Public Notice System at https://aws.state.ak.us/OnlinePublicNotices/default.aspx  .

After the public comment period ends, the Department of Health & Social Services will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected. Written comments received are public records and are subject to public inspection.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
