BRIEF DESCRIPTION

The Department of Law proposes to change regulations on the supervision of legal services to state agencies by the attorney general.

Summary of proposed changes: The Department of Law proposes to adopt regulation changes in Title 9 of the Alaska Administrative Code, dealing with the provision of legal services to state agencies, including the following:

(1)        9 AAC 02.010 is proposed as a new section of regulation setting forth the purposes of Chapter 2 relating to legal services.

(2)        9 AAC 02.015 is proposed as a new section of regulation relating to contracts for legal services.

(3)       9 AAC 02.020 is proposed as a new section of regulation relating to attorney employed by state agencies.

(4)        9 AAC 02.025 is proposed as a new section of regulation relating to supervision of legal services by the attorney general.

(5)       9 AAC 02.030 is proposed as a new section of regulation providing definitions for proposed Chapter 2 relating to legal services.

Written comments: You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to 1031 West 4th Avenue, Suite 200, Anchorage, AK 99501. Additionally, the Department of Law will accept comments by facsimile at 907-276-3697 and by electronic mail at law.regulations.comments@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system and using the comment link.

Written comment deadline: The written comments must be received not later than 5:00 p.m. on September 28, 2026.

Questions: You may submit written questions relevant to the proposed action to Richard Carter at 1031 West 4th Avenue, Suite 200, Anchorage, AK 99501 or faxed to 907-276-3697 or emailed to  law.regulations.comments@alaska.gov. The questions must be received at least 10 days before the end of the public comment period. The Department of Law will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System at https://aws.state.ak.us/OnlinePublicNotices/.

Public nature of comments and questions: Public comments and questions, once submitted, are public records and subject to disclosure under the Alaska Public Records Act. See AS 40.25.100 – 40.25.295. Do NOT include in your comments or questions any information that you do not want made public.

Final version of regulations: After the public comment period ends, the Department of Law will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
