Notice of Proposed Changes to 18 AAC 73: Repeal of Construction Grants

NOTICE OF PROPOSED CHANGES ON CONSTRUCTION GRANTS
IN THE REGULATIONS OF THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION

 

Summary of proposed changes: The Department of Environmental Conservation (DEC), Division of Water proposes to repeal 18 AAC 73 of the Alaska Administrative Code related to construction grants no longer utilized by the State of Alaska including:

            DEC proposes to repeal 18 AAC 73.010 – 18 AAC 73.060. The intended effect of this repeal is to ensure the public understands these regulations and the related program are no longer in effect.

Written comments: You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments electronically to the DEC public notice site at https://dec.alaska.gov/commish/public-notices/. Additionally, DEC will accept comments submitted by mail and addressed to Brock Tabor, DEC Division of Water at 410 Willoughby Ave. Suite 303. P.O. Box 111800 Juneau, Alaska 99811-1800 or by electronic mail to brock.tabor@alaska.gov.

Written comment deadline: The written comments must be received not later than 11:59 pm on August 14th, 2026.

Oral hearing: You may provide oral comments relevant to the proposed action via telephone at the hearing to be held on July 29nd, 2026 by calling 1-800-315-6338, access code 51851. There will not be in-person attendance provided at the hearing site, so please prepare to share your oral comments by telephone only.  The hearing is scheduled from 4 pm to 5 pm and priority will be given to commenters on the line before the beginning of the hearing. The hearing may be extended to accommodate those on the line before 4:30 pm who did not have an opportunity to comment. Before the start of the hearing, DEC may limit the time allotted for each person providing oral testimony, as reasonably necessary to conclude the hearing in the time provided.

Questions: You may submit written questions relevant to the proposed action to Brock Tabor, DEC Division of Water at 410 Willoughby Ave. Suite 303. P.O. Box 111800 Juneau, Alaska 99811-1800 or by electronic mail to brock.tabor@alaska.gov. The questions must be received at least 10 days before the end of the public comment period. DEC will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and https://dec.alaska.gov/water.

Public nature of comments and questions: Public comments and questions, once submitted, are public records and subject to disclosure under the Alaska Public Records Act. See AS 40.25.100 - 40.25.295. Do NOT include in your comments or questions any information that you do not want made public.

Obtaining copies of proposed regulations: A copy of the proposed regulation changes is available on the Alaska Online Public Notice System, are posted on the website of DEC, Division of Water and by contacting Brock Tabor at brock.tabor@alaska.gov or (907) 465-5185.

Final version of regulations. After the public comment period ends, DEC will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
