The Alaska Department of Natural Resources (DNR), pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that Alyeska Pipeline Service Company (APSC) submitted a request to amend the Trans-Alaska Pipeline System (TAPS) Right-of-Way (ROW) Lease, ADL 63574, to add State land to the ROW at two locations south of Deadhorse, Alaska.
A late spring breakup on the Sagavanirktok River resulted in flooding that inundated the larger floodplain and reduced the pipe cover at a relic oxbow of the river at Pipeline Milepost (PLMP) 28.3 (near Dalton Highway Milepost 388). APSC proposes to install a buried rock sill consisting of riprap to protect the integrity of TAPS by protecting the pipe from similar events in the future. A shallow trench would be excavated east of the Pipeline and filled with riprap. Voids in the rock would be filled with the excavated gravels, and organic soils from the trench would be placed on top of the disturbed trench area. Any excess gravel would be stockpiled or spread across a protected segment of the adjacent pipeline work pad. Equipment used would include rock trucks, backhoe and loaders.
Additionally, APSC has a continued need for a previously permitted storage and staging area adjacent to the TAPS ROW at PLMP 39.7, near Franklin Bluffs (Dalton Highway Milepost 377). The staging and storage area would support TAPS maintenance and repair work in the Sagavanirktok River floodplain.

The requested lands would be surveyed and may include less acreage than approved for construction.

AS 38.35.200 governs judicial review of decisions of the commissioner:
Sec. 38.35.200: Judicial review. (a) An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100.
(b) The only grounds for judicial review of a decision of the commissioner are
(1) failure to follow the procedures set out in this chapter; or
(2) abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.
