NOTICE OF PUBLIC EASEMENT

We are NOT soliciting public comment on this posting. It provides notice that a decision was signed and issued only.

In accordance with AS 38.05.850, the Division of Mining, Land and Water (DMLW) has issued a decision to authorize a public easement to Juneau Hydropower, Inc. for a 50-year term. The easement authorizes the use of approximately 23.23 acres of State land for an undersea electric transmission line combined with fiber optic cable along the tide and submerged lands within Berners Bay, approximately 40 miles north of Juneau, Alaska. The easement will be approximately 30 feet wide and traverse a total of 33,724 feet. The easement will be within Copper River Meridian Township 36 South, Range 62 East, Sections 1, 12, and 13; Township 36 South, Range 63 East, Sections 18,19, 30, 31 and 32; and Township 36 South, Range 62 East, Sections 1, 12, and 13. Although noticed as a 25-year authorization, DMLW has increased the proposed term length to 50 years.

An eligible person affected by this decision, and who provided timely written comment or public hearing testimony to the department, may appeal the decision to the DNR Commissioner per AS 44.37.011 and 11 AAC 02. Any appeal must be received within twenty (20) calendar days after issuance of this decision under 11 AAC 02.040. An eligible person must first appeal a decision to the Commissioner before seeking relief in superior court. The Alaska Court System establishes its own rules for timely appealing final administrative orders and decisions of the department. Appeals must be accompanied by the fee established in 11 AAC 05.160(d)(1)(F), which has been set at $200 under the provisions of 11 AAC 05.160 (a)-(b).
