Forest Land Use Plan Adoption

 

The Alaska Department of Natural Resources, Division of Forestry and Fire Protection (DOF), gives formal notice per 11 AAC 02 (Appeals) that the Division has adopted a site-specific Forest Land Use Plan (FLUP) under AS 38.05.112 and the administrative standards of AS 41.17.060 for the commercial timber sale:  Odyssey Timber Sale (Exchange Cove Subunit #2 SSE-1391-2).

 

This timber sale is located on Prince of Wales Island in Sections 1 and 12 of Township 66 South, Range 78 East, and Sections 6 and 7 of Township 66 South, Range 79 East of Copper River Meridian (CRM). The sale area is found within the Petersburg A-4 NE USGS quadrangle.  The main access for this sale area is from the existing Prince of Wales Road System.

 

The harvest units total approximately 290 acres and contain approximately 2,000 MBF of timber.  This volume was already sold under provisions of AS 38.05.118 to Viking Lumber Company Inc.

 

The FLUP intends to provide the best available information regarding the proposed timber harvest on 290 acres, and the management of other non-timber uses in compliance with AS 38.05.112 and AS 41.17.060, and must be adopted by the DOF before the proposed activity can occur. This FLUP does not determine whether or not to access and sell timber within the timber sale area, nor the method of sale. Those decisions have been made previously in the March 7, 2025 Best Interest Finding and are not appealable under this FLUP. The Commissioner signed the FLUP and it has been issued on November 15, 2025. An eligible person affected by this decision, and who provided timely written comment to the department, may appeal the decision to the DNR Commissioner per AS 44.37.011 and 11 AAC 02. Any appeal must be received within twenty (20) calendar days after issuance of this decision under 11 AAC 02.040. An eligible person must first appeal a decision to the Commissioner before seeking relief in superior court. The Alaska State Courts establish its own rules for timely appealing final administrative orders and decisions of the department.

Appeals must be accompanied by the fee established in 11 AAC 05.160(d)(6), which has been set at $200 under the provisions of 11 AAC 05.160 (a)-(b).

If no request for reconsideration is filed by that date, this decision goes into effect as a final order and decision 20 days after the adoption signature date.
