In accordance with 7 AAC 07.095, the Commissioner of the Department of Health (Department) has approved a modification to an original Certificate of Need (CON), initially approved on April 13, 2023, with the modification request below granted on August 22, 2025.

Applicant’s Name/Project Name: Aspen Creek/150 Bed Skilled Nursing Facility 

Service Area: Municipality of Anchorage

Project Description: Aspen Creek Management, LLC (ACM) to construct a skilled nursing facility at 5915 Petersburg Street, Anchorage, Alaska. The skilled nursing facility will be adjacent to its existing assisted living facility and consist of 150 skilled nursing units with an estimated cost of $48,130,508.

Summary of Modification: Under 7 AAC 07.095(b), ACM submitted a request for modification to extend the initial completion date of December, 2025 due to delays caused by current litigation.

Summary of Decision: In accordance with 7 AAC 07.095(c), ACM is granted a deadline extension with a new completion period of two years and eight months to begin the day after a summary judgment has been filed, matching the original length of time from the approval date of the CON application.

Public Input: Any member of the public who is substantially affected by activities authorized by this CON modification may initiate an administrative hearing in accordance with 7 AAC 07.082.
