LAS 2762 Request for Change in Appropriation

REQUEST FOR AMENDMENT
AMENDED CERTIFICATE OF APPROPRIATION OF WATER, LAS 2762

Pursuant to AS 46.15 and 11 AAC 93, notice is hereby given that a request for amendment has been received for LAS 2762 for withdrawals from Lake K214 and attached reservoir.

ConocoPhillips Alaska (certificate holder) requested an amendment to water right LAS 2762. The 2025 amendment to the Amended Certificate of Appropriation of Water will:

  1. Clarify that there is a lake (K214) with a connected manmade reservoir at this location.
  2. Update the name on the certificate to ConocoPhillips Alaska
  3. Remove Condition 7, as there are fish present in Lake K214, and include any additional conditions for surface water sources.
  4. Clarify the winter withdrawal under ice amounts for Lake K214 is 9,000 gallons total, any additional winter water withdrawals must occur from the reservoir.
  5. State that ice harvest can only occur from naturally grounded ice in Lake K214. For safety reasons, ice harvest will not occur from the attached reservoir.
  6. Correct the source legal description to remove the description of “point of take”, and update to: Lake K214 and reservoir in Sections 17, 19, 20, 29, Township 11 North, Range 9 East, Umiat Meridian.
  7. Use the unit of measurement from the application, original public notice, Statement of Beneficial Use, original permit and certificate (gallons). The water right was certified for 37,800,000 gallons total per year with a daily withdrawal limit of 103,562 gallons.

Please see the attached request for amendment. No change in the water amount, source, water use area or priority date is occurring with this amendment.

Per AS 46.15.133 and 11 AAC 93.930(b), within 15 days of publication or service of notice, persons may file with the director written objections stating the name and address of the objector, and any facts tending to show that rights of the objector or the public interest would be adversely affected by the proposed amendment. Objections must be made in writing by email to lesli.schick@alaska.gov or by mail to the Alaska Department of Natural Resources, Water Resources Section, 550 W 7th Ave, Suite 1020, Anchorage, AK 99501-3562 by 5PM June 2, 2025. After public and agency input is considered, a decision will be issued without further public notice. A copy of the decision will be sent to any person who provided an objection or written comment.
