Notice Of Proposed Regulations In Sick Leave For Department Of Labor & Workforce Development

NOTICE OF PROPOSED CHANGES ON PAID SICK LEAVE

IN THE REGULATIONS OF DEPARTMENT OF LABOR AND WORKFORCE DEVELOPMENT

 

BRIEF DESCRIPTION

 

The Department of Labor and Workforce Development proposes to adopt regulations on paid sick leave as approved under 2024 General Election Ballot Measure 1.

 

The Department of Labor and Workforce Development proposes to adopt regulation changes in 8 AAC 15.100, 8 AAC 15.106 - 8 AAC 15.119, 8 AAC 15.126(a), and 8 AAC 15.160(h) of the Alaska Administrative Code, dealing with paid sick leave as approved under 2024 General Election Ballot Measure 1, including the following:

 

  1. 8 AAC 15.100, is proposed to be amended to calculate the regular rate in regard to sick leave and overtime.

     

  2. 8 AAC 15 is proposed to be amended by adding new sections 8 AAC 15.106 – 8 AAC 15.119 regarding sick leave language.

 

(3)        8 AAC 15.126(a), is proposed to be amended to include language regarding sick leave with respect to an employee of a non-profit residential summer camp.

 

(4)        8 AAC 15.160(h) is proposed to be amended by adding two new paragraphs to include sick leave accrual and sick leave balance.

 

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Theric Austin at 1251 Muldoon Road, Suite #109 Anchorage AK 99504. Additionally, the Department of Labor and Workforce Development will accept comments by facsimile at 907-269-4950 and by electronic mail at dol.lss.regulations@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System, by accessing this notice on the system and using the comment link: https://aws.state.ak.us/OnlinePublicNotices/Default.aspx/. The comments must be received not later than 4:30 p.m. on July 31st, 2025.

 

You may submit written questions relevant to the proposed action to Theric Austin at dol.lss.regulations@alaska.gov. The questions must be received at least 10 days before the end of the public comment period. The Department of Labor and Workforce Development will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System: https://aws.state.ak.us/OnlinePublicNotices/Default.aspx/.

After the public comment period ends, the Department of Labor and Workforce Development will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.

Fiscal information The proposed regulation changes are not expected to require an increased appropriation.
