As provided in 18 AAC 15.220, the Division of Spill Prevention and Response and the permittee may file a response to the request for adjudicatory hearing by serving a response on the Office of Administrative Hearings, not later than 20 days after the issuance of this notice. The requester may file a reply within seven days of service of any timely filed response to the hearing request. Responses and replies may be 20 pages or less. Written responses and replies on the request for adjudicatory hearing may be served by mail addressed to:

The Office of Administrative Hearings will issue a recommended decision to the Commissioner whether to grant or deny the request for hearing or to remand the decision to the division director under 18 AAC 15.220(b). The Commissioner or the Commissioner’s designee will issue a decision on the request for adjudicatory hearing under 18 AAC 15.220(c).
