Notice of Request for Adjudicatory Hearing on Classification of Mustang Holding, LLC Oil Transmission Pipeline

Requester – Mustang Holding, LLC                                                                         

Contested Decision – The Alaska Department of Environmental Conservation (ADEC) Division of Spill Prevention and Response decision to classify the crude oil transmission pipeline that connects the Mustang Pad production facility to the Alpine Transportation Company as a “pipeline” as that term is defined by AS 46.04.900(18).

Background – The Requester disagrees with the Contested Decision.

As provided in 18 AAC 15.220, the Division of Spill Prevention and Response may file a response to the request for adjudicatory hearing by serving a response on the Office of Administrative Hearings, by November 18, 2024. The requester may file a reply within seven days of service of any timely filed response to the hearing request. Written responses on the request for adjudicatory hearing may be served by mail addressed to the Office of Administrative Hearings, P.O. Box 1101231, Juneau, AK 99811-0231 or the Office of Administrative Hearings, 550 W. Seventh Avenue, Suite 1940, Anchorage, AK 99501 or by email to doa.oah@alaska.gov. Please also serve a courtesy copy of the adjudicatory hearing request response to Jessalynn Rintala, Office of the Commissioner, Alaska Department of Environmental Conservation, P.O. The Office of Administrative Hearings will issue a recommended decision to the Commissioner whether to grant or deny the request for hearing or to remand the decision to the division director under 18 AAC 15.220(a). The Commissioner or the Commissioner’s designee will issue a decision on the request for adjudicatory hearing under 18 AAC 15.220.
