NOTICE OF WATER RIGHT APPLICATION
                                                                  LAS 35073

Pursuant to AS 46.15.133 and 11 AAC 93.080, notice is hereby given that Alaska Construction and Paving Inc, PO Box 874712, Wasilla, Alaska 99687 applied for a water right on May 17, 2024 (Priority Date). The application proposes water withdrawals associated with dewatering at the Fitz Gravel Extraction Pit in Wasilla, located off of Schrock Rd and E Shadow Circle.  Extracted water from the main pit will be placed into an infiltration basin on an adjacent parcel owned by the gravel company to naturally percolate back into the ground.

Source of Water: Shallow ground water in gravel pit in Section 15, Township 18 North, Range 1 West, Seward Meridian.

Amount of Water: 100 gallons per minute with a seasonal limit not to exceed 26,352,000 gallons from April through October.

Legal Description of the Area of Appurtenance includes two parcels of land owned by the applicant. The main gravel pit is Mat-Su Borough Lot B16 in the SW1/4 Section 15, Township 18 North, Range 1 West, Seward Meridian. The discharge location and work area is a parcel of land located within Mat-Su Borough Lot B10 in SW1/4 NW1/4 Section 15, Township 18 North, Range 1 West, Seward Meridian, Palmer Recording District, Third Judicial District, State of Alaska, being Parcel 1 of Waiver Resolution Serial No. 98-76-PWm, recorded November 20, 1998 in Book 984 at Page 903.

Per AS 46.15.133 (a), within 15 days of publication or service of notice, persons may file with the director written objections. Comments or objections must be made in writing by email to lesli.schick@alaska.gov or by mail to Alaska Department of Natural Resources, Water Resources Section, 550 W 7th Ave, Suite 1020, Anchorage, AK99501-3562 by 5:00 p.m. July 29th, 2024. Pursuant to 11 AAC 93.080 (6), “The public comment period set by AS46.15.133 (c) begins the first day the newspaper publication appears, or the first day of posting, or upon receipt of the notice as evidenced by the certified mail receipt, date stamp, or other evidence of actual service.”
