NOTICE OF PRELIMINARY DECISION FOR LEASE ADL 109315

Trevor Sande DBA Marble Seafoods, LLC

 

In accordance with AS 38.05.035, the Division of Mining, Land and Water (DMLW) has issued a preliminary decision to authorize a 25-year lease to Trevor Sande DBA Marble Seafoods, LLC (“Applicant”) for 0.5 acres of state-owned tide and submerged land in Ketchikan, Alaska.

The purpose of this application is for the site to be used by the applicant for shore-based processing of oysters and kelp operations. The proposed facilities would also house business operations and employee housing for Marble Seafoods, LLC., and Hump Island Oyster Company.

The proposed lease area is comprised of approximately 0.5 acres of state-owned tidelands adjacent to a private lot owned by the Sande’s, near Potter Point; adjacent to Betton Island, on the west side of Revillagigedo Island, approximately 9 miles north of Ketchikan International Airport. The proposed site will contain two structures and a parking lot within the lease boundary. 

There are two main shore-based retail/processing facilities as well as a parking lot proposed within the development plan the applicant submitted with the application.

Structure A is an existing floating structure which consists of a concrete pontoon that holds a 5,500 square foot, two-story wood framed building. Construction and refurbishment work to the lower floor of the building was done prior to moving the structure into the lease boundary on the tidelands. Structure A is currently moored approximately three hundred feet from the lease boundary. The applicant will use a “boom boat” to push Structure A into place on the tidelands adjacent to Lot 1. The lower floor of the facility will house the Marble Seafoods management offices, employee restrooms, seafood retail store, oyster tasting room, and a commercial kitchen for seafood processing. The upper floor has an existing 3-bedroom apartment that will be used for employee housing.

The parking lot will be constructed between Structure A and Structure B.

Structure B will be a two-story wood framed building, encompassing approximately 4,200 square feet, for shipping, processing, and wet storage of oysters. The structure will be constructed on a concrete foundation, placed over fill material on the tidelands.

Public notice of this preliminary written decision will be posted on the Alaska Public Notice System website for 30 calendar days. The public may provide written comments to DMLW during that time. Additionally, notice of this preliminary decision will be given to adjacent landowners. The United States Post Office - Ketchikan will also be requested to post the notice of this preliminary decision.

The public is invited to comment on this preliminary decision. Written comments must be received by DNR no later than 5:00 p.m. on March 25th, 2024. All comments must be submitted to: DNR, Division of Mining, Land and Water, Southeastern Regional Office by mail at P.O. Box 111020, Juneau, AK 99811-1020 or by electronic mail to quinlan.mcclurg@alaska.gov in order to ensure consideration. Please include your mailing address and telephone contact.  In order to establish appeal rights regarding this decision, you are required by law to meaningfully participate in the decision process by commenting on the decision, in writing, prior to the comment deadline. Following the deadline, all timely written comments will be considered, and DNR may modify this decision based on public comments received.

The names of commenters and comments received will be part of the public record.

If DNR determines that public comments in response to this notice indicate the need for significant changes to the decision, additional public notice will be given. If no significant changes are required, the preliminary decision, after any necessary minor changes, will be issued as a final decision. A copy of the final decision, along with instructions on filing an appeal, will be sent to all persons who comment on the preliminary decision. Persons who do not submit written comments during the comment period will have no legal right to appeal the final decision.

The Division of Mining, Land and Water reserves the right to waive technical defects in this publication.
