NOTICE OF PROPOSED CHANGES ON CONTINUING EDUCATION, LICENSEE DISCIPLINE, AND INTERNET ADVERTISING IN THE REGULATIONS OF THE ALASKA BOARD OF MASSAGE THERAPISTS

Brief Description: The Board of Massage Therapists (Board) proposes to adopt regulation changes in Title 12, Chapter 79 of the Alaska Administrative Code, dealing with clarification to license renewal continuing education requirements, grounds for disciplinary sanctions against licensees, and Internet advertising requirements. These changes include:

  1. 12 AAC 79.200 and 12 AAC 79.210 are proposed to be changed to clarify that continuing education documentation is not required to be provided to the board unless the licensee is audited. A licensee will instead provide an attestation that the required continuing education has been completed.
  2. 12 AAC 79.905 (Disciplinary sanctions) is proposed to be added to clarify the grounds for which the Board may issue disciplinary sanctions against a licensee, which include failure by a licensee to cooperate with an official Board investigation, failure to report disciplinary action from another entity to the Board within 30 days of the action, and conviction of a crime that affects the licensee’s ability to practice competently or safely.
  3. 12 AAC 79.950 (Internet advertising requirements) is proposed to be added to require message therapists and massage therapy establishments to include and display their license or registration number on all Internet advertisements and provides a definition for “Internet advertisement.”

Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system at http://notice.alaska.gov/214177, and using the comment link. The comments must be received not later than 4:30 p.m. on March 25, 2024. Comments received after this deadline will not be considered by the Board.
