Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws.
Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/.

Project Name: Silver Bay Seafoods Kodiak
Location: The proposed activity is located within Section 32, T. 27S, R. 19W; Seward Meridian; in Kodiak Island Borough, Alaska. Project Site (Latitude, Longitude): 57.79000, -152.39444. With potential discharge location shot rock at -152.39444, 57.79000.
Purpose: The purpose of this project is to construct an 80'x120', two-story marine services building and to repair a failing wood retaining wall and repair the pilings for an existing dock.
Project Description: The project plans to remove the existing log bulkhead and replace it with rip-rap armor rock for slope stabilization. Repair (27) 12" steel pilings under the existing concrete dock by encapsulating in a protective wrap and grouting and construct a two-story marine service building and an approximately 400-foot-long rip-rap slope stabilization on the seaward edge and replacing the failing wood retaining wall.
The project will discharge 9000 cubic yards of shot rock, 150 cubic yards of rip rap, and 214 cubic yards of concrete fill material into 0.33-acres of intertidal waters (below the high tide line and mean high water mark) in order to construct an 80-foot x 120-foot marine services building, repair a failing wood retaining wall, and repair (27) 12-inch steel piles.
After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.
