Notice of Proposed Amendments to 1915(c) Home and Community-Based Services Waivers and Request for Comments

The Division of Senior and Disabilities Services (SDS) is requesting public input from waiver recipients, waiver service providers, and other stakeholders on proposed amendments to four of Alaska’s 1915(c) home and community-based services waivers. 

The amended waivers are:

  1. People with Intellectual and Developmental Disabilities (IDD)
  2. Adults with Physical and Developmental Disabilities (APDD)
  3. Children with Complex Medical Conditions (CCMC)
  4. Individualized Supports Waiver (ISW)
  • IDD, APDD, and CCMC: The modification of the Residential Habilitation service to include: 1. Specialized Family Home Habilitation, and 2. Specialized Group Home Habilitation which will service highly acute participants with complex needs; and
  • IDD, APDD, CCMC and ISW: The allowance of Legally Responsible Individuals (LRIs) to provide In-Home Supports services and Supported Living services under specific circumstances.

The proposed waiver amendments are attached to this Online Public Notice. The proposed changes are highlighted in yellow.

SDS will accept public comment on the proposed waiver amendments until 5:00 pm, Monday, October 9, 2023.  Please send written comments to Jordyn Grant, SDS, 1835 Bragaw Street, Suite 350, Anchorage, AK 99508, or jordyn.grant@alaska.gov.  If you need accommodation to review the proposed waiver amendments, please contact Jordyn Grant at jordyn.grant@alaska.gov

Once the comments have been reviewed and necessary changes incorporated into the proposed waivers, the waivers will be submitted to the Centers for Medicare and Medicaid (CMS) to become effective in Spring 2024.

Webinar Information:

SDS will hold two webinars to give an overview of the waiver amendments.

  1. The webinar to explain the modifications to the Residential Habilitation service will be on Wednesday, September 20th, from 12:00 to 1:30pm.
  2. The webinar to explain the allowance of Legally Responsible Individuals (LRIs) to provide specific waiver services will be on Thursday, September 21st from 12:00 to 1:30pm.
