NOTICE OF PROPOSED CHANGES TO REJECT OR REVOKE ACCEPTANCE OF MARJIUANA PRODUCT AND TO TRANSPORTATION IN THE REGULATIONS OF THE MARIJUANA CONTROL BOARD

NOTICE OF PROPOSED CHANGES TO REJECT OR REVOKE ACCEPTANCE OF MARJIUANA PRODUCT AND TO TRANSPORTATION IN THE REGULATIONS OF THE MARIJUANA CONTROL BOARD

 

Brief Description:  The Marijuana Control Board proposes to change regulations in Title 3, Chapter 306 of the Alaska Administrative Code dealing with rejected or revoked acceptance of marijuana product and with transportation.

The Marijuana Control Board proposes to adopt regulation changes in Title 3, Chapter 306 of the Alaska Administrative Code, dealing with rejected or revoked acceptance of marijuana product and with transportation, including the following:

 

3 AAC 306.305(a) will be amended to allow a licensed retail marijuana store to reject or revoke acceptance of marijuana or marijuana product and to allow salvage and sale of kief, trim, or flower.

3 AAC 306.330(a) will be amended to track rejected or revoked acceptance of marijuana or marijuana product in the inventory tracking system of a licensed retail marijuana store.

3 AAC 306.330(b) will be amended to allow a licensed retail marijuana store to reject marijuana or  marijuana product that does not have a valid transport manifest.

3 AAC 306.405(a) will be amended to allow a licensed standard marijuana cultivation facility to accept rejected or revoked acceptance of marijuana from a licensed retail marijuana store.

3 AAC 306.480 will be amended to simplify wording by removing repetitive mention of marijuana cultivation facilities.  

3 AAC 306.505(a) will be amended to allow a licensed marijuana product manufacturing facility to reject or revoke acceptance of marijuana or marijuana product and to accept rejected or revoked acceptance of marijuana product.

3 AAC 306.540(a) will be amended to track the return of rejected or revoked acceptance of marijuana product in the inventory tracking system of a marijuana product manufacturing facility.

3 AAC 306.750(d) will be amended to address access to the secure storage compartment and the sealed package during transport and unnecessary stops during transport.

 

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Alcohol and Marijuana Control Office at 550 W. 7th Avenue, Suite 1600, Anchorage, Alaska, 99501.  Additionally, the Marijuana Control Board will accept comments by electronic mail at amco.regs@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System, by accessing this notice on the system and using the comment link. The comments must be received not later than 4:30pm on September 13, 2023.

You may submit written questions relevant to the proposed action to Alcohol and Marijuana Control Office by email to amco.regs@alaska.gov or by mail to 550 W. 7th Avenue, Suite 1600, Anchorage, Alaska, 99501. The questions must be received at least 10 days before the end of the public comment period. The Alcohol and Marijuana Control Office will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and https://www.commerce.alaska.gov/web/amco/

After the public comment period ends, the Marijuana Control Board will either adopt the proposed regulations or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
