Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. 

Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/.

To comment on the project or request for a public hearing with respect to water quality, submit comments electronically via the DEC public notice site at https://water.alaskadec.commentinput.com?id=mpt3PWSJg on or before the public notice expiration date listed above.

Location
The proposed activity is located within Section 12, T60s, R.83e; Copper River Meridian; in Wrangell, Alaska.  Project Site (Latitude, Longitude):  56.59026, -132.37272. With potential discharge locations for material extraction at 56.5902, -132.3727; 56.6854, -132.2443, 56.7009, -132.0611; and 56.5902, -132.3727

Purpose
The purpose of the proposed project is to provide the applicant with sand and gravel meeting specifications for use in a commercial earthwork operation. 

Project Description
The applicant proposes to extract sand and gravel from the bed of the Stikine River using an excavator aboard a barge.

The applicant proposes to perform work in navigable waters of the United States. Specifically, the applicant proposes to dredge up to 25,000 cubic yards of sand and gravel materials from three separate locations within the Stikine River; utilizing a hydraulic excavator located on a 28 foot by 80 foot barge. The three locations total 456.88 acres. Site A contains 76.88 acres, Site B contains 60 acres, and Site C contains 320 acres. The applicant states that dredging will create no side slopes during dredging as the river immediately refills the dredged area by sedimentation and hydraulic action. The dredged material will be stockpiled in an upland location. All jurisdictional work shall only occur between June 15th through November 15th for Site A and Site C, and May 1st through June 15th for Site B. 

Additional Information

The applicant has applied for a Fish Habitat Permit with the Alaska Department of Fish & Game and a Material Sale Permit with the Alaska Department of Natural Resources.

Applicant Proposed Mitigation
:
The applicant proposes the following mitigation measures to avoid, minimize, and compensate for impacts to waters of the United States from activities involving discharges of dredged or fill material.
a. Avoidance: N/A. The applicant’s proposed work will not discharge fill into waters of the United States as defined in 33 CFR part 323.
b. Minimization: N/A. The applicant’s proposed work will not discharge fill into waters of the United States as defined in 33 CFR part 323.
c. Compensatory Mitigation: N/A. The applicant’s proposed work will not discharge fill into waters of the United States as defined in 33 CFR part 323.

After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.
