Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. 

Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/.

Location
The proposed activity is located within Section 21, T. 73S, R. 118W; Seward Meridian; in Aleutians West Census Area, Alaska. Project Site (Latitude, Longitude):  53.84140, -166.58270. With potential discharge location(s) as follows (Latitude, Longitude): Existing riprap armor rock (salvage) 53.8414, -166.5827; Shot rock fill and rock riprap 53.8414, -166.5827. 

Purpose:
The purpose of the fill is to expand the pad area at the existing marine cargo dock to increase cargo handling efficiency and safety, and for staging additional cargo volume. The existing cargo operations are constrained due to the lack of adequate space at the dock.

Project Description

The applicant proposes to discharge 17,000 cubic yards of shot rock fill and riprap into 0.65-acres below the high tide line (HTL; 5.2 feet above the 0.0-foot contour) of Captains Bay, a navigable water of the United States. The proposed fill area will be about 300 linear feet long parallel to the shore. The total fill area below the HTL will be about 28,300 sq ft., (0.65 acre). The total fill volume of both shot rock fill and riprap rock to be placed below the HTL is about 17,000cy. Of this volume about 850cy will be relocated riprap that is presently located along the dock face below the HTL.  Therefore, the approximate volume of new rock fill material is about 16,150cy. The proposed work includes the excavation and dredging of the existing riprap located along the fill slope. Excavated rock would be temporarily staged on the pad. Approximately 850 cubic yards of existing riprap would be salvaged and used in the proposed fill slope. The placement of rock fill material would be completed using standard heavy equipment including end-dumps, side-dumps, excavators, dozers, and compactors. Riprap placement would be completed using excavators and cranes. The excavation and placement of rock fill below the HTL would be done during low tidal stages as practicable. The proposed work is expected to take place between September and November 2023.

Applicant Proposed Mitigation
The applicant proposes the following mitigation measures to avoid, minimize, and compensate for impacts to waters of the United States from activities involving discharges of dredged or fill material:
a. Avoidance: The applicant states that avoidance is not possible because to achieve the project purpose, the proposed fill area must be located at the existing dock face.
b. Minimization: The applicant states that impacts would be minimized by implementing Best Management Practices, including the placement of clean quarried rock material during low tides, as practicable. The riprap would be placed with an excavator or crane, which would minimize turbidity. No special aquatic sites or wetlands will be filled by the proposed work at the proposed location.
c. Compensatory Mitigation: The applicant proposes no mitigation.

After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.
