Notice of Application for State Water Quality Certification - POA-2023-00206 v1.0 - Glacier Creek, Glacier View LLC - Alpine View Estates Subdivision - Tract B-2A

Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws.

Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/.

Project Name: Alpine View Estates Subdivision - Tract B-2A

Location: The proposed activity is located within Section 17, T. 10N, R. 2E; Seward Meridian; in Anchorage, Alaska. Project Site (Latitude, Longitude): 60.95991, -149.12521. With potential discharge location(s) as follows: Hardware store, road, and associated parking lot -149.124168, 60.959677; Hotel, road, and associated parking lot -149.126945, 60.960413.

Purpose: The applicant’s stated purpose is to construct a commercial development including a hotel and a hardware store in Girdwood, Alaska.  Glacier View LLC plans to develop this property to support a 50-room hotel, hardware store and corresponding parking lots, roads, and utilities.

Project Description: The project purpose is to construct commercial structures in one of the only commercially zoned areas of Girdwood. Specifically, Tract B-2A, is zoned as 'Upper Alyeska Highway Commercial' (GC-10). Development of this area to include a hotel and hardware store would be a benefit to the community that does not currently have an alternative to the existing resort and does not have an existing hardware store.

A large portion of this project will be constructed within wetlands. The placement and compaction of suitable fill material will be necessary to support development because avoidance of wetlands during development is not possible.

Proposed Work: Construction of a commercial development including hotel, hardware store, parking lots, access roads, and sidewalks. Specifically, the work within to include discharge of fill into 1.57-acre of palustrine wetlands to construct an approximately 115-foot-long by 70-foot-wide fill pad for the hotel, approximately 120-foot-long by 67-foot-wide fill pad for the hotel parking lot, approximately 270-foot-long by 24-foot-wide driveway for the hotel, an approximately 353-foot-long by 24-foot-wide access road connecting the commercial development, approximately 250-foot-long by 5-foot-wide sidewalk, and an approximately 224-foot-long by 98-foot-wide fill pad encompassing the hardware store and hardware store parking lot.

Additional Information: The applicant has received the following additional permits. from other state or local agencies: Alaska Department of Fish and Game Fish Habitat Permit (FH22-II-0115), Alaska Department of Environmental Conservation Construction General Permit (AKR10CJ24), Municipality of Anchorage Private Development/Subdivision Agreement (21-005/22-001), and Alaska Department of Transportation Approval to Construction (31462).

Applicant Proposed Mitigation: The applicant proposes the following mitigation. measures to avoid, minimize, and compensate for impacts to waters of the United States from activities involving discharges of dredged or fill material.

  1. Avoidance: The applicant has provided the following statement regarding avoidance of waters of the U.S.: wetland impact was avoided via reducing the size of the hotel and hardware store parking lots via the Municipality of Anchorage Ordinance No. AO 2022-80.
  2. Minimization: The applicant has provided the following statement regarding minimization of impact to waters of the U.S.: the proposed project will utilize clean fill and stage materials within uplands, storm water runoff will be managed via a stormwater pollution prevention plan and erosion control measures in-place to reduce impacts to adjacent waters of the U.S., and natural hydrology patterns to be maintained.
  3. Compensatory Mitigation: The applicant has proposed no compensatory mitigation and states the use of a July 26, 2005, land swap of parcels in the vicinity of proposed project between the applicant and Heritage Land Bank should be compensatory mitigation. The applicant received 1.92-acres from Heritage Land Bank which were developed into the subdivision Glacier View Estates and Heritage Land Bank received 8.41-acres of undeveloped land (Tract A-2D).

After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.
