Notice of Application for State Water Quality Certification

Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. 

Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/.

To comment on the project or request for a public hearing with respect to water quality, submit comments electronically via the DEC public notice site at https://water.alaskadec.commentinput.com?id=5aEDZN4ep  on or before the public notice expiration date listed above.

Project Name
Utqiagvik Phase VI Landfill Expansion

Location
The proposed activity is located within Section 19, T. 22N, R. 17W; Umiat Meridian; in North Slope Borough, Alaska. Project Site (Latitude, Longitude):  71.24186, -156.55356. With potential discharge location of Gravel fill at: -156.551, 71.242; Section 24, T. 22N, R. 18W.  

Purpose
The applicant’s stated purpose is to increase local, permanent, solid waste storage in Utqiagvik.

Project Description
This project proposes to expand the landfill by opening Cell #5 in preparation for operation in the next five years.  The existing Cells #3 and #4 are nearing capacity faster than originally projected, due to a spike of activity in Utqiagvik including several large cleanup projects.

The landfill is designed, constructed, and operated as a freezeback landfill. The continuous permafrost on-site will be protected from degradation by insulating with adequate gravel fill to prevent thawing once the landfill cells are constructed. 

Utqiagvik is isolated for 10 months of the year from surface transportation. Barge traffic serves Utqiagvik during summer months. Frequent removal of solid waste to a regional landfill is not practical. Local, permanent, solid waste storage is necessary for Utqiagvik.

This project will Discharge 26,155 cubic yards of gravel into 4.2 acres of wetlands to construct the solid waste landfill. 

After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.
