Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws.

Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at http://dec.alaska.gov/water/wastewater/.

Project Name: Nushagak River ASRC New Stuyahok Airport Material Site

Location: The proposed activity is located within Section 28, T. 8S, R. 47W; Seward Meridian; in Dillingham Census Area, Alaska. Project Site (59.456149, -157.296550). 

Purpose: The purpose of excavation and discharge is to provide gravel for the New Stuyahok Airport resurfacing project. The only discharge will be topsoil returned to the excavation site after mining.

Project Description: This material site will provide gravel for the New Stuyahok Airport resurfacing project. The site is located on an Island in the Nushagak river. The site will be excavated to various depths, at a maximum of 10 feet. The total excavation area is approximately 7.1 acres. A 50-foot vegetative buffer will remain on all sides between the material site and the Nushagak River. Topsoil will be removed from the material site prior to excavation and stockpiled and stabilized along the east and west boundaries of the site. Salvageable trees at the material site will be stockpiled for community use. When mining is complete, a pond will be left in the middle of the island. Stockpiled topsoil will be returned to the excavation site. A fish channel will be constructed at the northwest corner of the excavation site at the depth of the excavation site to allow trapped fish to escape.


After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.
