NOTICE OF ADOPTION OF EMERGENCY REGULATION ON EFFECTIVE DATE OF RENEWAL LICENSES IN THE REGULATIONS OF THE DEPARTMENT OF COMMERCE, COMMUNITY, AND ECONOMIC DEVELOPMENT

Brief Description: The Department of Commerce, Community, and Economic Development, Division of Corporations, Business and Professional Licensing proposes to update regulation changes made by emergency regulation regarding effective date of renewal licenses.

On September 9, 2022, the Department of Commerce, Community, and Economic Development, Division of Corporations, Business and Professional Licensing (Division) adopted, as an emergency regulation, changes in 12 AAC 02.940 of the Alaska Administrative Code dealing with effective date of renewal licenses, including the following:

12 AAC 02.940. Effective date of renewed licenses, is proposed to be amended as follows:
“If an application and payment for renewal of a license is submitted but the division is unable to complete its review of the application before the expiration of the license, the license may be automatically extended for three months or until the division completes its review and either approves or denies the application, whichever occurs earlier”. This emergency regulation allows licensees to continue to work until their renewal license is processed by the division.

The emergency regulation took effect on September 12, 2022, and will expire January 9, 2023. The Division does not intend to make the emergency regulation permanent.
