On May 25, 2022, the Department of Natural Resources, Division of Mining, Land, and Water adopted regulation changes in Title 11, Chapter 90 of the Alaska Administrative Code. The changes update sections dealing with ownership and control and valid existing rights associated with coal mining operations. The changes are being made to bring the State regulations into compliance with federal regulation associated with the Surface Mining Control and Reclamation act.

The regulation changes were reviewed and approved by the Department of Law, signed and filed by the Lieutenant Governor on June 7, 2022, and will go into effect on July 7, 2022. See attached copy of the filed version of the regulations.

The new regulation changes will be printed in Register 243, October 2022 of the Alaska Administrative Code.
