NOTICE OF WATER RIGHT APPLICATION

Pursuant to AS 46.15 and rules and regulations promulgated there under, public notice is hereby given that an application has been received from the Kenai Hydro LLC to appropriate water as follows:
Up to 395cubic feet per second from Grant Lake located approximately 2 miles southeast of Moose Pass. The hydroelectric project is located on Grant Creek and draws water from Grant Lake via an intake structure and tunnel. Instream flows (bypass flows) are included as part of the license from the Federal Energy and Regulatory Commission (FERC). The holder of this permit must adhere to all conditions in FERC license P – 13212. Further information about the project can be found at the DNR’s website https://dnr.alaska.gov/mlw/grant-lake-hydro/
The public is invited to comment on these actions. Any facts tending to show that the rights of any person or the public interest would be adversely affected by the proposed water appropriation must be submitted in writing to the Water Resources Section by May 9, 2022 at the above address to be considered. Comments that might assist the Water Resources Section in its determination of the public interest pursuant to AS 46.15.080 are also requested and must be received in writing by the above deadline. In order to establish appeal rights regarding this decision, you are required by law to meaningfully participate in the decision process by commenting on the decision, in writing, prior to the comment deadline. If issued, permits may be extended for good cause shown, pursuant to AS 46.15.110 and 11 AAC 93.120(f), without additional public notice.
