NOTICE OF PROPOSED CHANGES ON CHILD SUPPORT SERVICES IN THE REGULATIONS OF THE DEPARTMENT OF REVENUE

NOTICE OF PROPOSED CHANGES ON CHILD SUPPORT SERVICES IN THE REGULATIONS OF THE DEPARTMENT OF REVENUE

 

BRIEF DESCRIPTION:  The Department of Revenue proposes to change existing regulations pertaining to 15 AAC 125 (Alaska Administrative Code) regarding Child Support Services extended visitation credit, requests by a parent to review support orders, sending request for administrative review by first class mail or electronic means, and conforming and clarifying changes related to these amendments, including the following:

 

  1. 15 AAC 125.118(a). Administrative review of notice and finding of financial responsibility, is proposed to be amended to remove the requirement that a request for administrative review shall be sent by certified mail, return receipt; amended to add that the request shall be sent by first class mail or electronic means.
  2. 15 AAC 125.327(d). Review of support orders at the request of a parent, is proposed to be amended to add the agency will refer the parent to the tribunal with jurisdiction for the review.
  3. 15 AAC 125.327(e). Review of support orders at the request of a parent, is proposed to amended to remove that the parent must provide financial and medical information listed in 15 AAC 125.040(b).
  4. 15 AAC 125.327(f). Review of support orders at the request of a parent, is proposed to be amended to remove the agency will review all information available including the financial and medical information submitted and, if appropriate, the data provided by the Department of Labor and Workforce Development; amended to remove that not later than 30 days after the request the agency will provide the parents a child support calculation and the address of the court with authority to modify the support order.
  5. 15 AAC 125.480(e). Credit for extended visitation, is proposed to be amended to remove the credit that the agency applies if no percentage or dollar amount are specified in the support order. Civil Rule 90.3(a)(3) requires the support order to specify the amount of a visitation credit. No further determination is needed by the agency.

 

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Chrysti Brevogel at the Department of Revenue, Child Support Services Division at Post Office Box 101365, Anchorage, AK 99510-1365. Additionally, the Department of Revenue will accept comments by facsimile at (907)787-3121 and by electronic mail at dor.cssd.regulations@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system and using the comment link. The comments must be received not later than 4:00 p.m. on Wednesday, March 23, 2022.

 

You may submit written questions relevant to the proposed action to Chrysti Brevogel at  dor.cssd.regulations@alaska.gov or Post Office Box 101365, Anchorage, AK 99510-1365. The questions must be received at least 10 days before the end of the public comment period. The Department of Revenue, Child Support Services Division will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and the Child Support Services Division website, www.childsupport.alaska.gov.

After the public comment period ends, the Department of Revenue will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
