SUPPLEMENTAL NOTICE OF PROPOSED CHANGES IN THE REGULATIONS OF THE MARIJUANA CONTROL BOARD REINSTATEMENT-FAILURE TO RENEW

SUPPLEMENTAL NOTICE OF PROPOSED CHANGES IN THE REGULATIONS OF THE MARIJUANA CONTROL BOARD

REINSTATEMENT-FAILURE TO RENEW

 

Brief description: the Marijuana Control Board proposes to change regulations in Title 3, Chapter 306 of the Alaska Administrative Code dealing with the reinstatement of a license. The changes amend several sections to incorporate the reinstatement of a license for failure to renew on time, including a reinstatement fee.

The Marijuana Control Board proposes to adopt regulation changes in 3 AAC 306 of the Alaska Administrative Code, dealing with reinstatement of license – failure to renew, including the following:

  • 3 AAC 306.035 is amended, including adding new subsections, to allow for a licensee to submit a renewal application along with a statement of reasons for failure to submit a renewal application on time no later than September 30 of the year on which the license expired.
  • 3 AAC 306.080 is repealed and readopted for logical progression. The “new” language is (c) which lays out provisions for which the board will deny an application for reinstatement including, but not limited to, the application was submitted later than September 30 of the applicable year, the applicant was granted a reinstatement within ten years prior, or the failure to submit a timely renewal application is due to excusable oversight.
  • Adds the word/phrase “reinstatement” or “license reinstatement” to 3 AAC 306.085, 3 AAC 306.090, and 3 AAC 306.095.
  • 3 AAC 306.100(b) is amended to include the non-refundable reinstatement fee.

This is a SUPPLEMENTAL NOTICE adding to the NOTICE OF PROPOSED CHANGES that was issued August 27, 2021, concerning these proposed regulation revisions contained in the Department of Law file number 2020200666. This SUPPLEMENTAL NOTICE is being issued because changes have been made to the draft language in 3 AAC 306.080(c).

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Alcohol and Marijuana Control Office at 550 West 7th Avenue, Suite 1600, Anchorage AK 99501. Additionally, the Marijuana Control Board will accept comments by email at amco.regs@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system and using the comment link. The comments must be received not later than 4:30 pm on March 16, 2022.

You may submit written questions relevant to the proposed action to the Alcohol and Marijuana Control Office at 550 West 7th Avenue, Suite 1600, Anchorage, AK 99501 or to amco.regs@alaska.gov. The questions must be received at least 10 days before the end of the public comment period. The Alcohol and Marijuana Control Office will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and AMCO website.

After the public comment period ends, the Marijuana Control Board will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected. Written comments received are public records and are subject to public inspection.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
