NOTICE OF PROPOSED CHANGES IN THE REGULATIONS OF THE ALASKA BOARD OF PHARMACY

Brief Description: The Board of Pharmacy proposes to update regulations regarding its qualifications and requirements to apply for an emergency permit and renewal application requirements for pharmacists, pharmacy technicians, pharmacies, outsourcing facilities, wholesale drug distributors, and third-party logistics providers. It also proposes to repeal the emergency courtesy license, update duties of its executive administrator as it relates to renewal application processing, and establish temporary courtesy licenses for an active duty military member or their spouse.

The Board of Pharmacy (Board) proposes to adopt regulation changes in Title 12, Chapter 52 of the Alaska Administrative Code including the following:

  1. 12 AAC 52.105. Temporary military courtesy licenses, is a proposed new section that establishes temporary courtesy licenses for an active duty military member or spouse of an active duty military member of the armed forces of the United States to practice as a pharmacist, pharmacy intern, or pharmacy technician. The proposed regulations will allow for an expedited temporary licensing pathway for those in the military and their spouse.
  2. 12 AAC 52.110. Emergency permit to practice as a pharmacist, pharmacy intern, or pharmacy technician, is proposed to amend the emergency permit language as the intent was duplicative to the emergency courtesy license option.
  3. 12 AAC 52.300. License renewal, is proposed to update language to be all inclusive of pharmacy license and registration types; clarifies renewal must be on department form; replaces copy of inspection report for pharmacies or facilities with an attestation; clarifies eligibility for renewal or new application required if there is a change; and adds administrative and executive administrator processing language.
  4. 12 AAC 52.993. Executive administrator, is proposed to amend the executive administrator’s duties by adding the ability to review and approve licenses or registrations as long as the applicant meets the requirements of the established checklist as codified in the regulations; clarifies role of executive administrator; creates efficiencies by allowing task delegation of the board to staff.

Box 110806, Juneau, AK  99811-0806. Additionally, the Board will accept comments by facsimile at (907) 465-2974 and by electronic mail at RegulationsAndPublicComment@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system at http://notice.alaska.gov/205318, and using the comment link. The comments must be received not later than 4:30 p.m. on March 8, 2022. Comments received after this deadline will not be considered by the Board.

The Board will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and on the Board’s website at https://www.commerce.alaska.gov/web/cbpl/ProfessionalLicensing/BoardofPharmacy.aspx. The Board may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.

The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.
