Post-Filing Notice
Adopted and Filed Regulations Oil & Gas Production Tax
On November 9, 2021 the Department of Revenue, Tax Division adopted regulation changes to Title 15, Chapter 55 of the Alaska Administrative Code relating to the Oil and Gas Production Tax and Oil Surcharge, Alaska Statutes, Title 43, Chapter 55. The changes relate to the attribution of lease expenditures in determining production tax value of oil, the taxable value of gas, including gas used in the state, conforming and clarifying changes related to the oil and gas production tax, and definitions.
The regulations were publicly noticed in September 2021. The regulations have been reviewed and approved by the Department of Law, signed and filed by the Lieutenant Governor on November 24, 2021 and will go into effect on January 1, 2022. The regulations will be published in Register 240, January 2022. However, only regulations filed prior to October 15, 2021 will appear in the January Register. The printed version of the regulations will appear in the April supplement and show the January 2022 date and register.
