Adopted Regulations of the Marijuana Control Board - Marijuana Product Packaging - Eff. 12.5.21

The Marijuana Control Board has amended its regulations regarding marijuana product exit packaging.

3 AAC 306.345(a)(3) is amended and reads: at the point of sale, marijuana or a marijuana product sold is packaged in resealable, child-resistant packaging designed or constructed to be significantly difficult for children under five years of age to open, but not normally difficult for adults to use properly.

3 AAC 306.345(a)(4) is new and reads: unless already packaged by the cultivation facility or the manufacturing facility in an opaque package for final retail sale, any marijuana or marijuana product purchased by the consumer is placed in an opaque package by the retail marijuana store or the consumer before the consumer exits the retail marijuana store.

3 AAC 306.345(c) is new and reads: In this section, "opaque" means a packaging material that does not allow the contents of the package to be seen without opening the package. 

The Lieutenant Governor signed and filed the regulation on November 5, 2021, with an effective date of December 5, 2021. 

The regulations will appear in Register 240, January 2022, of the Alaska Administrative Code. Additionally, updated regulations will be available on our website by December 5, 2021. Please direct questions to amco.regs@alaska.gov.
