Any applicant for a federal license or permit to conduct an activity that might result in a discharge into navigable waters, in accordance with Section 401 of the Clean Water Act (CWA) of 1977 (PL95-217), also must apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws.

Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ Reference Number POA-2004-01127, Isabella Creek, has been received for the discharge of dredged and/or fill materials into waters of the United States (WOUS), including wetlands, as described below. The public notice and related project figures/drawings are also accessible from the DEC website at http://dec.alaska.gov/water/wastewater/.

Project Name: Northside Subdivision

Location: The proposed activity is located within Section 2, T. 1 S., R. 1 W., Fairbanks Meridian; Latitude 64.861° N., Longitude -147.684° W.; North Star Borough, Northside Business Park, Lots 1-45; in Fairbanks, Alaska.

Purpose: The applicant’s stated purpose is to remove and sell mineral materials (sand, gravel, and peat) from the project site, and then sell finished graded lots.

Project Description: The applicant has previously performed work on the site under the Corps of Engineers (Corps) permit, POA-2004-01127 M1-M9, for the purpose of the development and sale of subdivision lots in the Bentley Trust North Subdivision (Lots 6-45). Fill material in 36.9 acres of wetlands for the construction of roads, sewer and water utilities, and driveways were approved by the Corps in the individual permit issued on August 29, 2008. In the future, the applicant proposes to use clean fill to backfill areas that are mined for mineral materials in order to recontour the area and prepare the commercial lots for sale. The applicant does not intend to place any additional fill beyond the originally permitted 36.9 acres. Vegetation in portions of the site (to include Tract A and B) will be cut and removed in the winter to curb homeless occupation. Fill will not be placed in Tract A or B. The gravel project will be constructed and operated over multiple seasons, and the project lifespan will be based on material sales.

After reviewing the application, the Department may certify there is reasonable assurance the activity, and any discharge that might result, will comply with the CWA, the Alaska Water Quality Standards, and other applicable State laws. The Department also may deny or waive certification.

All comments should include the PN reference number listed above in the subject heading of the email. Mailed comments must be postmarked on or before the expiration date of the public notice.
