Notice of Application to Amend Certificate of Public Convenience and Necessity

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice on June 9, 2020, a Joint Application has been filed by the Interior Alaska Natural Gas Utility (IGU) and Fairbanks Natural Gas, LLC (FNG) seeking approval to merge FNG’s natural gas distribution Certificate of Public Convenience and Necessity (Certificate) No. 514 into IGU’s natural gas distribution Certificate No. 753. Docket No. U-20-028 was opened to address this matter.

FNG is an Alaska limited liability company, wholly owned by IGU. IGU is a public corporation of the Fairbanks North Star Borough (FNSB). FNG and IGU are presently certificated to provide natural gas distribution service in their respective designated service areas within the FNSB. The above referenced Joint Application requests approval of the merger of FNG into IGU such that IGU’s natural gas distribution service area would be expanded to include FNG’s natural gas distribution service area such that IGU would provide service from such expanded area (FNG and IGU would merge under Certificate No. 753 and discontinue the use of Certificate No. 514).

IGU was created as a public corporation by the FNSB, a political subdivision of the State, and, pursuant to AS 42.05.711(b), IGU and FNG are exempt from the Alaska Public Utilities Regulatory Act (AS 42.05) other than AS 42.05.221 through AS 42.05.281. As such, IGU and FNG are exempt from economic regulation by the Commission. “Economic regulation” is a generic term which includes matters concerning a utility’s rates and charges, quality of service, management practices, and customer complaints. The Commission has no jurisdiction over matters that constitute economic regulation.

No motions for waiver or petitions for confidentiality were filed with the application.

The Commission has not assessed the completeness of the application. The Commission will determine whether the application is complete by June 30, 2020.
