NOTICE OF APPLICATIONS TO ACQUIRE CONTROLLING INTEREST

 

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on December 2, 2019, Shawn DeVore (DeVore) filed an application to acquire 50 percent controlling interest in Circle Electric, LLC (CE), and an application to acquire 50 percent controlling interest in Circle Telephone and Electric, LLC (CTE). CE holds Certificate of Public Convenience and Necessity No. 256, authorizing electric utility services in Circle, Alaska. Docket No. U-19-099 was opened to address this matter. CTE holds Certificate of Public Convenience and Necessity No. 463, authorizing the provision of local exchange telephone service in Circle, Alaska. Docket No. U-19-100 was opened to address this matter.

If the Commission grants both applications, there will be a change in management of both utilities. The applications stated there will be no impact on CE’s and CTE’s current rates, terms, or services.

As CE does not gross $500,000 annually and elected for deregulation in accordance with AS 42.05.712, it is exempt from economic regulation in accordance with AS 42.05.711(f). As a telecommunications provider, CTE is exempt from economic regulation per
AS 42.05.711(u). Economic regulation means regulation of matters concerning a utility's rates and charges, along with quality of service. As such, neither CE nor CTE are subject to the Commission’s jurisdiction over matters that constitute economic regulation.

No motions for waiver or petitions for confidentiality were filed with the applications. The Commission has not assessed the completeness of the applications. The Commission may determine whether the applications are complete by December 23, 2019.
