Notice of Public Scoping for Possible
DNR Regulation Revisions
Under Administrative Order 266
Appeal Regulations
The Alaska Department of Natural Resources (DNR) is considering drafting regulation revisions regarding its process for filing and handling appeals and requests for reconsideration, 11 AAC 02.
The department last adopted significant revisions to these regulations in 2001, following the Alaska Legislature’s passage of AS 44.37.011 regarding administrative appeals of department decisions and decisions of the commissioner. Since these regulations were last revised, DNR has handled hundreds of appeals and requests for reconsideration. As a result, DNR has identified the need for clarifications and revisions to improve the appeal process and address ambiguities and uncertainties. DNR believes that revising these regulations would best serve the public and parties affected by DNR decisions.
The purpose of this notice is to ask the public for their ideas and suggestions in developing regulations before the department undertakes the task of drafting any specific proposed regulations for public review. These ideas and suggestions can be as broad or as narrow, or as general or as specific, as a submitter may wish.
The department is not currently proposing any specific regulations at this time. There are no draft regulations to review. The department is soliciting feedback and comments from the public on whether and how the department could revise its regulatory framework related to providing public notice regarding certain land management issues before the formal process of drafting any proposed regulations begins.

Written suggestions or other input should identify which regulation or provision of regulation their suggestions or other input applies. DNR will consider the submitted information if and when DNR proposes regulatory developments. Any proposed regulatory developments will subsequently be released for public review and comment under the Administrative Procedures Act AS 44.62.
