SUPPLEMENTAL NOTICE OF ORAL PUBLIC HEARING ON PROPOSED CHANGES REGARDING VIOLATION FINE SCHEDULES IN THE REGULATIONS OF THE MARIJUANA CONTROL BOARD

The Marijuana Control Board proposes to adopt regulation changes in 3 AAC 306 of the Alaska Administrative Code, dealing with establishing a violation fine schedule, including the following:

            3 AAC 306.805 is proposed to be amended to make changes for reporting inspections or advisories.   

            3 AAC 306.807 is a proposed new section establishing a table of fines and penalties for violations.

            3 AAC 306.810 is proposed to be amended to include “endorsement” under suspensions or revocations.

            3 AAC 306.820 is proposed to be amended to add “endorsement”

            3 AAC 306.830 is proposed to be amended regarding seizure of marijuana or marijuana products

            3 AAC 306.840 is proposed to be amended to include “civil fines”

            3 AAC 306.845 is proposed to be amended regarding the appeal process

The proposed changes to these regulations provide for a civil fine schedule and appeals process for violations of 3 AAC 306 of the Alaska Administrative Code.

This is a SUPPLEMENTAL NOTICE adding to the NOTICE OF PROPOSED CHANGES that was issued on February 27, 2019, concerning these proposed regulations contained in the Department of Law file number JU2019200187. This SUPPLEMENTAL NOTICE is being issued because the Marijuana Control Board has decided to hold oral hearings on the proposed fine schedule and regulations. The hearing will be held during the upcoming Marijuana Control Board meeting on July 10, 2019. The oral public hearing will take place at 1 pm at the Fairbanks North Star Borough Assembly Chambers, 907 Terminal Street, Fairbanks, AK. You must sign up in person or email amco.regs@alaska.gov by 1:30 pm on July 10, 2019, if you wish to testify.
