NOTICE OF AMENDED PRELIMINARY DECISION TO ISSUE EASEMENT

Southern Energy, Inc.
 

In accordance with AS 38.05.035, the Division of Mining, Land and Water (DMLW) has issued an amended preliminary decision to authorize a 50-year private non-exclusive easement to Southern Energy Inc. (“Applicant”) for approximately 24 acres of state-owned uplands and rights-of-way located near Walker Lake within the Haines State Forest, approximately 30 miles northeast of Haines. The easement is to construct and maintain an access road, a penstock, and a buried transmission line related to the Applicant’s proposed 1-megawatt hydropower project at Walker Lake.

The subject lands are in: Copper River Meridian, Township 28 South, Range 55 East, Sections 27,32, & 34 (DNR reservation and easements across University-owned land); & Copper River Meridian, Township 29 South, Range 55 East, Sections 1, 2, & 3 (state-owned land); Copper River Meridian, Township 29 South, Range 56 East, Section 6 (state-owned land).

Public notice of this amended preliminary written decision and the associated documents will be posted on the Alaska Public Notice System website for 30 calendar days (http://notice.alaska.gov). The public may provide written comments to DMLW during that time. Additionally, notice of the amended preliminary decision will be given to adjacent landowners. The Haines post office will also be requested to post the notice of the amended preliminary decision.

The public is invited to comment on the amended preliminary decision. Written comments must be received by DNR no later than 5:00 p.m. on December 28, 2018. All comments must be submitted to: DNR, Division of Mining, Land and Water, Southeastern Regional Office by mail at 400 Willoughby Avenue, P.O. Box 111020, Juneau, AK 99811-1020, by fax at 907-465-3886, or by electronic mail to chris.carpeneti@alaska.gov to ensure consideration. Please include your mailing address and telephone contact.  DNR reserves the right to issue additional public notice as it determines necessary.

Following the close of the comment period, all timely written comments will be considered, and DNR may make appropriate revisions to the decision or issue the amended preliminary decision as a final written decision. A copy of the final decision will be sent to all persons who comment on the amended preliminary decision. Persons who are aggrieved by the final decision will have the right to appeal it.

The Division of Mining, Land and Water reserves the right to waive technical defects in this publication.
