NOTICE OF UTILITY TARIFF FILING

 

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that Matanuska Electric Association, Inc. (MEA) filed TA491-18, proposing to amend aspects of its tariff pertaining to the liability of the utility for damages resulting from a loss or curtailment of power. Specifically, MEA proposes to re-organize its rules governing liability and add new language governing liability for irregularity or failure of service, customer’s equipment, and consequential damages.                                

MEA’s proposed language states that the utility will not be liable for damages caused by interruptions, shortages, irregularities, or failures due to accidents or conditions attributed to uncontrollable forces.  MEA also proposes a statement that it shall be the consumer’s responsibility to ensure that the consumer’s structures, equipment, wires, conduit, appliances, and devices conform to, and are installed in compliance with, this tariff and with all applicable federal, state, and local government statutes, regulations, and ordinances.  Finally, MEA proposes to add language that provides that it is not liable for any injury, casualty, loss, or damage resulting in any way from the supply or use of electricity to or by its customers, or from the presence or operation of MEA’s structures, equipment, wires, conduit, appliances, or devices on the consumer’s premises unless injury or damage results from the sole negligence of MEA.
