DECISION REJECTING TENDER OF LANDS IN GAKONA, ALASKA BY AHTNA, INCORPORATED TO THE STATE OF ALASKA IN TRUST FOR A FUTURE CITY

DECISION REJECTING TENDER OF LANDS IN GAKONA, ALASKA

BY AHTNA, INCORPORATED
TO THE STATE OF ALASKA IN TRUST FOR A FUTURE CITY

Pursuant to Section 14(c)(3) of the Alaska Native Claims Settlement Act, (ANCSA), 85 Stat. 688, AS 44.33.755(a) and 3 AAC 190.015, Ahtna Incorporated has offered to convey the surface estate of the following described lands to the State of Alaska, in trust, for any future city that might be established in the Village of Gakona, Alaska in complete satisfaction of the requirements of ANCSA Sec. 14(c)(3):

The surface estate of land in Township 6 North, Range 1 East, Copper River Meridian, Chitina Recording District, being situated in the Native village of Gakona, Alaska, more particularly described as follows:

        Lots 3, 4, and 5 of Plat No. 83-12, Chitina Recording District

The above described lands were conveyed to the State in trust by Ahtna, Incorporated on May 2, 1984 by Modified Quitclaim Deed recorded at Book 19 Pages 431-433, Chitina Recording District, along with a 0.935 acre parcel representing the subdivision road.  A map of the 14(c)(3) land is available for viewing at the Municipal Lands Trustee Program office in Anchorage.

In determining whether to accept the tender, the Municipal Land Trust Officer has applied the procedures and standards in 3 AAC 190.015 and .020.  It has been determined that the tender should not be accepted.

This notice is being posted and published in accordance with the requirements of 3 AAC 190.015(3) and .910.  The decision becomes final upon the expiration of 30 days after the date of its receipt by the village corporation, the date of publication, or the date of posting, whichever is latest, unless the decision is appealed to the Commissioner in accordance with 3 AAC 190.940.

In accordance with 3 AAC 190.940, this decision may be appealed to the Commissioner of the Department of Commerce, Community, and Economic Development by any person whose interests are adversely affected by this decision.  In order to be considered, any appeal must be postmarked or otherwise received by the Municipal Land Trust Officer before the decision becomes final.
