In accordance with 7 AAC 07.031, the Department of Health and Social Services (DHSS) has determined that a certificate of need is not required for the health care project or activity described below:

Project/Activity:  Alaska Surgery Center is specifically seeking to relocate as an ambulatory surgery center in Anchorage to a new location in Anchorage.

Applicant’s Name: Alaska Surgery Center

Project/Activity Service Area: Anchorage, Alaska

Estimated Cost of Project/Activity: Estimated cost is $14,971,240

Summary of Decision: In accordance with A.S. 18.07.031(c), a person who is lawfully operating a health care facility that is an ambulatory surgical facility at a site may make an expenditure of any amount in order to relocate the services of that facility to a new site in the same community without obtaining a certificate of need as long as neither the bed capacity nor the number of categories of health services provided at the new site is greater. 

After review of the proposed relocation, it has been determined that a CON is not required for the proposed project because neither the bed capacity nor the number of categories of health services provided at the new site is greater.

A person who requested a determination under 7 AAC 07.031 may seek reconsideration of the determination by submitting a written request for reconsideration to the department.  A request for reconsideration must be postmarked no later than February 10, 2015 and be made in conformance with 7 AAC 07.033.  A decision under 7 AAC 07.033 constitutes the final administrative decision of the department.
