Extension of Lease Agreement ADL 18451
DNR Case Nos. ADL 103757 and ADL 104337
Subject to AS 38.05.070(f), the Southeast Regional Land Office issued decision for the following:
APPLICANT: Southeast Stevedoring Corporation
PROJECT NAME: ADL 103757 & ADL 104337
GEOGRAPHIC LOCATION: State tide and submerged lands near Saxman, Ketchikan Gateway Borough
LEGAL DESCRIPTION: Three parcels, within the Copper River Meridian, Township 75 South, Range 91 East, Section 33, and Township 76 South, Range 91 East, Section 4, containing 1.6 acres in the Ketchikan Recording District. More specifically, the parcels are described as follows:
ADL 103757: Two parcels containing a sum of 1.16 acres, more or less
1) Tract A, ATS 196, approximately .63 acres, and
2) Tract A, ATS 1465, approximately .53 acres.
ADL 104337: Tract B-1, Alaska Tideland Survey 1465, approximately .44 acres
ACTION: The Southeast Regional Land Office issued a decision for DNR Case Nos. ADL 103757 and ADL 104337 approving a two-year extension of Lease Agreement ADL 18451. ADL 103757 and ADL 104337 are cases created by partial assignments of Lease Agreement for ADL 18451, which authorized marine transport operations on state land from July 26, 1962 through July 26, 2017. The DMLW found it to be in the best interest of the state to extend the lease expiration to July 26, 2019 after considering:
• Applicable statutes and regulations;
• Southeast Stevedoring Corporation’s renewal applications were timely submitted;
• An extension is necessary to prolong authorization while the DMLW considers the renewal applications; and
• The economic return to the state provided by the authorized activity.
During that time, Southeast Stevedoring Corporation may continue land use subject to all the terms and conditions as outlined by the base lease agreement as subsequently assigned and amended.
DATES OF EXTENSION: June 26, 2017 through June 26, 2019

A person affected by this decision may appeal it in accordance with 11 AAC 02. Any appeal must be received within 20 calendar days after the date of “issuance” of this decision, as defined in 11 AAC 02.040(c) and (d) and may be mailed or delivered to the Commissioner, Department of Natural Resources, 550 W. 7th Avenue, Suite 1400, Anchorage, Alaska 99501; faxed to (907) 269-8918, or sent by e-mail to dnr.appeals@alaska.gov. If no appeal is filed by the appeal deadline, this decision becomes a final administrative order and decision of the department on the 31st calendar day after issuance. An eligible person must first appeal this decision in accordance with 11 AAC 02 before appealing this decision to the Superior Court. A copy of 11 AAC 02 may be obtained from any regional information office of the Department of Natural Resources.
