NOTICE OF UTILITY APPLICATION TO RELINQUISH CERTIFICATE

 

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on September 6, 2017, Thomas Bay Power Authority (TBPA) filed an application to relinquish Certificate of Public Convenience and Necessity (Certificate) No. 377 for the provision of electric service. Docket No. U-17-084 was opened to address this matter.

The Borough of Petersburg, Alaska and the City and Borough of Wrangell, Alaska created TBPA as a joint agency. In Commission Order U-86-063(1), the former Alaska Public Utilities Commission granted Certificate No. 377 authorizing TBPA to operate and maintain the Lake Tyee Hydroelectric Project (Project) and provide wholesale electric service to the Wrangell and Petersburg municipal electric utilities.

Per AS 42.05.261(a), a public utility may not discontinue or abandon a service for which a certificate has been issued by the Commission unless an application has been filed by the public utility and if, after notice and opportunity for hearing, the Commission finds that the continued service is not required by public convenience and necessity.

TBPA states that operation and maintenance responsibility for the Project has been transferred to the Southeast Alaska Power Agency. TBPA asserts that, if the application is approved, there will be no effect on the wholesale electric service provided from the Project.

No motions for waiver or petitions for confidentiality were filed with the application. The Commission has not assessed the completeness of the application. The Commission may determine whether the application is complete by September 27, 2017.
