NOTICE OF UTILITY APPLICATIONS FOR CONSTRUCTION OF NEW

WATER UTILITY AND FOR TRANSFER OF SERVICE AREA

 

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on May 25, 2017, Eagle Utilities, Inc. (Eagle) filed an application for an Initial Finding of Public Convenience and Necessity to construct a stand-alone new public water utility in the View Pointe at the Ranch Subdivision (View Pointe). Docket No. U-17-038 was opened to address this matter.

The Commission also gives notice on May 25, 2017, the City of Wasilla (Wasilla) and Eagle (together, Applicants) jointly filed an application to transfer a portion of Wasilla’s public water utility service area to Eagle. Wasilla possesses Certificate of Public Convenience and Necessity (Certificate) No. 262. Eagle possesses Certificate No. 356. The Applicants are seeking to transfer the area where View Pointe is proposed to be developed from Wasilla to Eagle. Docket No. U-17-039 was opened to address this matter.

View Pointe is located directly southwest of the Parks Highway intersection with Trunk Road. Phase 1 of the View Pointe development will consist of 36 homes, with the ultimate goal of expanding to 220 homes in six phases. The View Pointe development is currently within Wasilla’s public water utility service area, but Wasilla’s public water utility does not extend to the area in which View Pointe is proposed to be developed. Eagle seeks to construct and operate a stand-alone public water utility to support the View Pointe development.

The Commission has approved a petition filed by Eagle for a consolidated public notice of the application for an initial finding of public convenience and necessity and the application for transfer of service area from Wasilla to Eagle. However, the Commission has not approved or denied Eagle’s application in Docket No. U-17-038. If the Commission determines that the proposed stand-alone public water utility to serve View Pointe is not required, the application filed in Docket No. U-17-039 will become moot. No motions for waiver or petitions for confidentiality were filed with these applications. The Commission has not assessed the completeness of the applications. The Commission may determine whether the applications are complete by June 16, 2017.
