NOTICE OF ADOPTED CHANGES IN THE REGULATIONS OF THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION
Regulations dealing with aboveground storage tanks were adopted by the Department of Environmental Conservation on April 21, 2017, with an effective date of June 24, 2017. The regulations have been made permanent and have been filed by the Lt. Governor. The regulations will appear in Register 222, July 2017, of the Alaska Administrative Code. The regulations changes are summarized as follows:
These are new regulations addressing Class 2 facilities that store noncrude oil in aboveground storage tanks (ASTs), that have storage capacities of 1,000 gallons or greater, and are not subject to spill contingency planning regulation under AS 46.04.030. In 2015 the Alaska Legislature requested that the department reduce costs of expensive clean-ups and response. These regulations were developed in response to that legislative directive and are expected to reduce the financial impact on the state, communities, and owners and operators. These regulations require the owner or operator of a Class 2 facility to register with the department and defines the ASTs subject to these regulations.
