 NOTICE OF FILING A PETITION WITH THE LOCAL BOUNDARY COMMISSION TO INCORPORATE NIKISKI AS A HOME RULE CITY The Local Boundary Commission (LBC) has received a local action petition from Nikiski residents to incorporate Nikiski as a home rule city in the northwest section of the Kenai Peninsula Borough. The proposed city, if approved, would be 5,480 square miles. The proposed city boundaries are shown in the map below. They span Cook Inlet and include Tyonek. If the LBC approves this petition, incorporation will be subject to a vote by registered voters within the proposed city.

Standards governing incorporation of home rule cities are established in AS 29.05.011 — 150;3 AAC 110.005— 042; and 3 AAC 110.900 — 990. Procedures governing city incorporation are set out in 3 AAC 110.400 — 700.

The legal description for the territory proposed for incorporation and the proposed home rule charter can be found in the petition materials. The petition materials,including a map of the territory proposed for incorporation, are available for public review at the following locations, days, and times:  

1.      Nikiski Post Office, 51708 Kenai Spur Hwy,daily, 8 a.m. - 7 p.m.

2.      Treehouse Restaurant Community Board, 51708 Kenai Spur Hwy, Monday-Saturday, 7 a.m.-9 p.m.

3.      The Studio, 53437 Nikiski Avenue,Tuesday-Saturday, 8 a.m.-2 p.m.

4.      Nikiski Library, Mile 23.4 Kenai Spur Hwy,Monday-Friday 10 a.m. -8 p.m. / Sat. 10 a.m.-1 p.m.

5.      Native Village of Tyonek Tribal Office,Monday-Friday, 9 a.m.-4 p.m.

6.      Nikiski website, www.NikiskiInc.org,anytime

7.      LBC website, anytime

Interested persons may submit written comments with the LBC regarding the incorporation petition. Additionally, a person with the capacity to sue may file a responsive brief supporting or opposing the petition with the LBC. Written comments and responsive briefs must be filed in accordance with 3 AAC 110.480 and 3 AAC 110.700. A person who files a responsive brief (as distinguished from a written comment)gains certain procedural rights and duties during the petition proceedings.Responsive briefs and comments must be received by the LBC by 4:30 pm,March 8, 2017 in the office below:
