NOTICE OF PROPOSED CHANGES ON ELIGIBILITY FOR FUNDAMENTALS OF ENGINEERING AND LAND SURVEYING EXAMINATIONS, EDUCATION AND EXPERIENCE REQUIREMENTS FOR EXAMINATIONS IN THE REGULATIONS OF THE BOARD OF REGISTRATION FOR ARCHITECTS, ENGINEERS, AND LAND SURV

Notice of Proposed Changes on Eligibility for Fundamentals of Engineering and Land Surveying Examinations, and Education and Experience Requirements for Examinations in the Regulations of the Alaska State Board of Registration for Architects, Engineers, and Land Surveyors

Brief Description: The Alaska State Board of Registration for Architects, Engineers, and Land Surveyors proposes to change regulations by repealing the regulations requiring an application for the fundamentals of engineering and land surveying examinations, updating the requirements for education and experience requirements for examinations, and updating regulations to be in line with the National Council of Architect Registration Boards (NCARB).

The Alaska State Board of Registration for Architects, Engineers, and Land Surveyors (Board) proposes to adopt regulation changes in Title 12, Chapter 36, of the Alaska Administrative Code, dealing with updating the name of the program and forms used by NCARB for experience and education, eligibility for fundamentals of engineering and land surveying examination, education and work experience requirements, eligibility for professional land surveyor examination, adding language to broaden the scope of approved work experience, and updating definitions, including the following:

  1. 12 AAC 36.060, Eligibility for architect examination and registration, is proposed to be changed to accurately reflect the name of the program used by the National Council of Architect Registration Boards (NCARB) used to gain and document experience before becoming an architect.

  2. 12 AAC 36.061, Architect education requirements, is proposed to be changed to accurately reflect the name of the form required by the National Council of Architect Registration Boards (NCARB) used for education requirements to use to register for examination.

  3. 12 AAC 36.062, Eligibility for fundamentals of engineering examination, is proposed to be repealed. The intended effect of this repeal is to eliminate the requirements for applicants to apply to the board for approval to take the examination.

  4. 12 AAC 36.063, Engineering education and work experience requirements, is proposed to be changed to alter the education and experience requirements in order to be eligible to sit for the professional engineering examination.

  5. 12 AAC 36.064, Eligibility for fundamentals of land surveying examination, is proposed to be repealed. The intended effect of this repeal is to eliminate the requirements for applicants to apply to the board for approval to take the examination.

  6. 12 AAC 36.065, Eligibility for professional land surveyor examination, is proposed to be changed to alter the education and experience requirements in order to be eligible to sit for the professional land surveyor examination.

  7. 12 AAC 36.105, Engineer registration by comity, is proposed to be changed to add language to broaden the scope of approved work experience that can be used to apply for an engineering registration.

  8. 12 AAC 36.990, Definitions, is proposed to be changed to replace the definition IDP to AXP for record keeping of education and training through the National Council of Architect Registration Boards (NCARB).   

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Marilyn Zimmerman, Paralegal, Division of Corporations, Business and Professional Licensing, P.O. Box 110806, Juneau, AK 99811-0806. Additionally, the Board will accept comments by facsimile at (907) 465-2974 and by electronic mail at RegulationsAndPublicComment@alaska.gov. The comments must be received not later than 4:30 p.m. on January 23, 2017. Comments received after this deadline will not be considered by the Board.

The Board will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System or on the Board’s website at https://www.commerce.alaska.gov/web/cbpl/ProfessionalLicensing/BoardofArchitectsEngineersandLandSurveyors.aspx. The Board may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.

After the public comment period ends, the Board will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulations may be different from that of the proposed regulations. You should comment during the time allowed if your interests could be affected. Written comments and questions received are public records and are subject to public inspection.
