Notice of Proposed Prospective Purchaser Agreement, Contaminated Sites Program, Denali 7th & K LLC

The Alaska Department of Environmental Conservation and Alaska Department of Law are proposing to enter into a Prospective Purchaser Agreement under AS 46 and 18 AAC with Denali 7th & K, LLC relating to the 7th and K Property in Anchorage, Alaska (“Agreement”).  The 7th and K Property consists of the property at 624, 626, 634 K St and 1009 and 1015 West 7th Avenue. The Agreement involves Existing Contamination beneath the surface of the Property.  The Agreement specifies restrictions on the use of the Property to protect human health and the environment and permits ADEC to access the Property. In exchange, the Agreement provides Denali with a covenant not to sue from the State of Alaska and contribution protection under 42 U.S.C. 9613(f)(2).

The publication of this Notice opens a period for public comment on the proposed Agreement.  Comments should be addressed to Contaminated Sites Program Manager, and should refer to the 7th and K PPA.  All comments must be submitted no later than 30 days after the publication of this Notice.  Comments may be submitted either by email to: Jennifer.roberts@alaska.gov or by mail to: Contaminated Sites Program Manager, 555 Cordova Street, Anchorage, AK 99501. 

During the public comment period, the proposed Agreement may be examined and downloaded at: http://dec.alaska.gov/spar/csp/public-notices.htm.  We will provide a paper copy of the Agreement upon written request to the above mailing address.
