Proposed Amendment to Regarding Common Carrier Dispensary Licenses

3 AAC 304.340 Chapter 3 "Common Carrier Dispensary License" is amended to add new sections (e), (f), (g), and (h) as follows:

3AAC 304.340 Common Carrier Dispensary License

(e) For purposes of AS 04.11.180(a), a boat licensed for a state or federal agency for passenger travel includes a 12-pack uninspected marine vessel only if the marine vessel has 3 5or more staterooms for overnight passenger travel. No other type of uninspected marine vessel qualifies as a common carrier for purposes of obtaining a common carrier dispensary license, unless it is licensed by a state or federal agency for passenger travel.

(f) Notwithstanding any other provision in AS 04.16.049, a person 16 or 17 years of age may enter and remain within the licensed premises of a common carrier in the course of employment if (1) the employment does not involve the serving, selling, mixing, delivering, or dispensing of alcoholic beverages; (2) the person has the written consent of a parent or guardian; and (3) an exemption from the prohibition of AS 23.10.355 is granted by the Department of Labor and Workforce Development.

(g) Notwithstanding any other provision in AS 04.16.049, a person 18, 19, or 20 years of age may enter and remain within the licensed premises of a common carrier in the course of employment if the employment does not involve serving, selling, mixing, delivering, or dispensing of alcoholic beverages.

(h) Notwithstanding any other provision in AS 04.16.049, a person under the age of 21 may enter and remain within the licensed premises of a common carrier during passenger travel without a parent or guardian.

The Alcoholic Beverage Control Board proposes to adopt amendments to add two new subsections to regulations in 3 AAC 340 of the Alaska Administrative Code. These proposed new subsections relate to regulations concerning common carrier dispensary licenses, including the following:

1) 3 AAC 304.340(e) – Common carrier dispensary licenses regulations are proposed to be amended by adding a new section describing what type of uninspected vessel qualifies for a common carrier dispensary license. The proposed amendment allows certain vessels to qualify for a common carrier dispensary license.

2) 3 AAC 304.340(f) – Common carrier dispensary licenses regulations are proposed to be amended by adding a new section describing under what circumstances a person 16 or 17 years of age may be employed on a common carrier holding a common carrier dispensary license.

3) 3 AAC 304.340(g) – Common carrier dispensary licenses regulations are proposed to be amended by adding a new section describing under what circumstances a person 18, 19, or 20 years of age may be employed on a common carrier holding a common carrier dispensary license.

4) 3 AAC 304.340(h) – Common carrier dispensary licenses regulations are proposed to be amended by adding a new section permitting a person under the age of 21 to travel on a common carrier holding a common carrier dispensary license without a parent or guardian.

Additionally, the Alcoholic Beverage Control Board will accept written comments by electronic mail at amco.admin@alaska.gov. Please notate "Comment on Common Carrier Requirements" on the subject line of any emailed comment. Written comments may also be submitted through the Alaska Online Public Notice System, by accessing this notice on the system and using the "comment" link. Please indicate the article and section number to which each comment refers, if applicable. Please indicate in the subject line "Comment on common carrier requirements". All written comments must be received no later than 4:30 p.m. on January 13, 2017.

You may submit written questions relevant to the proposed regulations by email to amco.admin@alaska.gov or to Cynthia Franklin at the above physical address. Please do not submit questions through the Alaska Online Public Notice System. The written questions must be received at least 10 days before the end of the public comment period, by January 3, 2017 at 4:30 p.m. The Alcoholic Beverage Control Board will aggregate its response to substantially similar written questions and make the questions and response available on the Alcoholic Beverage Control Board website. The Alcoholic Beverage Control Board may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.

After the written public comment period ends, the Alcoholic Beverage Control Board will either adopt the proposed regulations or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulations may be different from that of the proposed regulations. You should comment in writing during the time allowed if your interests could be affected. No verbal public comment will be taken on the proposed regulations.
