U-16-045 Public Notice

NOTICE OF UTILITY PETITION

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on April 12, 2016, the Healy Lake Village Council filed a petition for exemption from regulation as an electric utility pursuant to AS 42.05.711(d) and/or AS 42.05.711(e). Docket No. U-16-045 was opened to address the petition.

Alaska Power Company (APC) is the only certificated electric utility in the Healy Lake area. On April 14, 2015, the Commission issued an order allowing APC to temporarily suspend providing electric utility service in the area. The Healy Lake Village Council proposes to provide service in the area and has entered into an agreement to buy the operating assets in Healy Lake from APC. Once the agreement is completed, Healy Lake Village Council will provide service in the area and APC will permanently discontinue service. Pursuant to AS 42.05 the Commission is provided the authority to certificate public utilities with revenues over a certain threshold, and to economically regulate other public utilities. Certification involves a Commission determination that the utility is fit, willing, and able to provide the proposed service, and that the proposed service is required by the public convenience and necessity. Economic regulation refers to Commission regulation of a utility’s rates and charges, quality of service, and management practices. AS 42.05.711(d) allows the Commission may exempt a utility from all or a portion of AS 42.05, if the Commission finds the exemption is in the public interest. Healy Lake Village Council may also be exempt under AS 42.05.711(e), which allows an electric utility that does not gross $50,000 annually to be exempt from AS 42.05 unless the subscribers petition the Commission for regulation. The Healy Lake Village Council seeks exemption from both certification and economic regulation.

This notice does not address in detail all of the points contained in the filing. The Commission may approve or impose conditions that vary from those proposed.
