 NOTICE OF FILING A PETITION WITH THE LOCAL BOUNDARY COMMISSION FOR INCORPORATION OF WHALE PASS AS A SECOND CLASS CITY

 

The Local Boundary Commission has received a petition to incorporate the community of Whale Pass as a second class city by local action. The petitioner’s representatives are Don Hull and Dick Erickson. The area proposed for incorporation is located on Prince of Wales Island in southeast Alaska and is approximately 26 square miles of land and water.

Standards governing incorporation of second class cities are established in Alaska Statutes 29.05.011-.150; and 3 AAC 110.005-.042; and 3 AAC 110.900-990. Procedures governing city incorporation by the local action method are set out in 3 AAC 110.400-700.

The legal description of the territory proposed for incorporation can be found in the petition. The petition and related documents, including a map of the territory proposed for incorporation, are available for public review at the following locations, days, and times:  

Public library (Monday and Friday 3-5 p.m.; Tuesday 1-3 p.m.; Wednesday 4-6 p.m.; Saturday 11 a.m.-3 p.m.)

Any interested person may file written comments with the LBC regarding the incorporation petition. Additionally, a person with the capacity to sue may file a responsive brief supporting or opposing the petition with the LBC. Written comments and responsive briefs must be filed in accordance with 3 AAC 110.480 and 3 AAC 110.700. The LBC has suspended 3 AAC 110.700(d) so the public is not required to send an original if an electronic comment has already been filed. A person who files a responsive brief (as distinguished from a written comment) gains certain procedural rights and duties during the petition proceedings. Responsive briefs and written comments must be received by the LBC by 4:30 pm, March 11, 2015 in the office below:

 Commenters must either send a copy of the comments to the petitioner and file a statement indicating that submission, or notify the department of an inability to send comments to the petitioner. Comments can be sent to the petitioner at:
